Pirate Band Competition T&Cs - 21st April 2021 - 5th May 2021

COMMON TERMS USED IN THESE RULES:

These are the official rules that govern how these Pirate Studios sweepstakes will operate. This will be simply referred to as the “Pirate Band Comp” throughout the rest of these rules.
 
In these rules, “we,” “our,” “us” and “sponsor” refer to PIRATE LTD, 13 ROTHBURY ROAD, LONDON E9 5HA, the sponsor of the Focusrite competition. “You” refers to an eligible Band Competition  Entrant, or their Parent / legal guardian if the Focusrite Competition Entrant is considered a minor. 

1. All artists/band members must be aged 16 or over to enter this competition.
2. Artists/band members must hold valid UK addresses
3. A minimum of 1 winner will be picked from artists/bands that have an active Pirate account
4. Bands may only submit 1 song for entry. All additional entries after the first will be disregarded for the judging
5. Artists who apply outside of set timeframes (21st April 2021, 9:00 - 5th May 2021 23:59) will not be considered for entry
6. Pirate can exclude any band at its discretion at any time if felt appropriate by Pirate
7. 1 winner picked by judges at Pirate and Focusrite

 
WHAT ARE THE ENTRY DATES?

This competition starts at 9 a.m. Greenwich Mean Time (“GMT”) on 21st April 2021 and ends at 23:59 GMT on 5th May 2021 (“Entry Period”).  See http://www.worldtimeserver.com/ for your local time.

 
CAN I ENTER?

You are eligible to enter this Pirate Band Competition if you meet all of the following requirements at the time of entry:

•   You are a legal resident of and are currently residing in the UK
•   You are 16 years of age or older at the time of entry. Note that if you are considered a minor in your place of residence, you should ask for your parents’ or legal guardians’ permission to enter, as any prize won by a minor will be awarded to the parent / legal guardian who must first have agreed to these rules in order to receive the prize;

• You are NOT an employee of the sponsor or of Pirate or Focusrite or of their respective parents, subsidiaries and agents; 

• You are NOT involved in any part of the administration and execution of this Focusrite competition; and
• You are NOT an immediate family (parent, sibling, spouse or child) or household member of an employee of the Sponsor or of Focusrite competition.
 
This Pirate Band Competition is void outside the geographic area described above and where prohibited by law. All UK laws and regulations apply.

 
HOW DO I ENTER?

To enter, you must: (a) have a valid Pirate Studios account; (b) during the Entry Period, reply to the tweet [hyperlink] on the Twitter account (@piratedotcomUK) with a track you have released.
 
Limit one Entry per person. You may not create multiple accounts using multiple identities to gain more than one entry.  To be eligible, your Entry must meet the following requirements:
 
Entry Requirements:

(a) You must have an active Pirate account connected to an active email address
(b) You must agree to Pirate’s Terms of Use (see here) and Pirate’s Privacy Policy (see here) 

By submitting an Entry you agree to these rules and confirm your Entry conforms to the Entry Requirements and all other criteria set out herein. We are not responsible for Entries that we do not receive for any reason, or for Entries that we receive but are not decipherable for any reason. We will at our sole discretion disqualify any Entry received which does not meet the Entry Requirements or does not otherwise comply with these rules.

WINNER SELECTION AND PRIZES
 
One prize winner (the “Winner”) will be drawn at 9 a.m. GMT on 5th May 2021 from all valid Entries received during the Entry Period.
 
If, in the sponsor’s sole opinion, there are insufficient valid Entries received, the sponsor reserves the right not to award the advertised prize or to terminate the competition. The decision of the sponsor is final and binding on all matters relating to this competition
 
Prizes:
 
The Winner shall receive the following prizes:
 
1. 1 x filmed Live Performance at Pirate Studio Hackney Wickt to be redeemed on or before 31st July 2021

2. 1 x Press pack (headshots and press shots) bundle to be shot on location by PIRATE.COM in-house production team on or before 31st July 2021.

All costs not expressly stated in the prize descriptions above, including but not limited to any taxes payable, are the sole responsibility of the Winners. The sponsor shall not be liable to the Winners for any damage caused to, or loss of, any prize at any point during production leading up to the aforementioned end date.

  
Notifications

The Winner and runners up shall be notified on 5th May 2021 via the PIRATE.COM Twitter account to the Twitter account they provided when entering the competition (or via any other method of communication that they have consented to sponsor contacting them by) and shall be provided with instructions for claiming their prize.  If the notification is returned undeliverable or if the selected Winner does not respond within three (3) days of sponsor’s first attempt to contact them, at sponsor’s sole discretion, they will forfeit their prize and sponsor may award the prize to another person who has submitted a valid entry, such person to be randomly selected from all valid Entries received during the Entry Period. 
 
If there is a dispute as to who is the Winner, we will consider the Winner to be the authorized account holder of the email address used to enter the competition.
 
If you are selected as Winner or runner-up, you may be required to sign an affidavit of eligibility, liability release, publicity release (unless prohibited by law), and tax documents (the “Documents”). If you do not complete the required Documents as instructed and/or return the required Documents within the time period listed on the winner notification message, we may disqualify you and select an alternate winner who will be selected using the same criteria as that used to select the original Winner.
 
If you are confirmed as the Winner of this competition:

•    You may not exchange the prize for cash or any other merchandise or services. However, if for any reason an advertised prize is unavailable, we reserve the right to substitute a prize of equal or greater value; 
•    You may not designate someone else as the winner. If you are unable or unwilling to accept your prize, we will award it to an alternate potential winner; 
•    If you accept the prize, you will be solely responsible for all applicable taxes related to accepting the prize; and
•    Unless otherwise noted, the prize is subject to the supplier’s terms and conditions.
 

WHAT ARE YOUR ODDS OF WINNING?

Your odds of winning this competition depend on the number of valid entries we receive and the quality of your track submitted. 
 

WHAT OTHER CONDITIONS ARE YOU AGREEING TO BY ENTERING THE FOCUSRITE COMPETITION?

By entering this competition you agree:

•   To abide by these rules; 
•   To release and hold harmless Sponsor and its respective parents, subsidiaries, affiliates, employees, and agents from any and all liability or any injury, loss or damage of any kind arising from or in connection with this competition (including, without limitation, in connection with any prize won, any Entries submitted, the administration and operation of the competition and the use, non-use or misuse of any prize awarded);

•   That sponsor’s decisions will be final and binding on all matters related to this Focusrite Competition; and
•   That by accepting the prize, if requested by sponsor, you agree to be used in publicity for the Pirate Band competition; and that sponsor may use your likeness and your proper name and state or country of residence online and in print, or in any other media, in connection with this Pirate Band competition;  without payment or compensation to you, except where prohibited by law.
 

WHAT LAWS GOVERN THE WAY THIS PIRATE BAND COMPETITION IS EXECUTED AND ADMINISTERED?

This Pirate Band Competition will be governed by the laws of England and Wales, and you consent to the exclusive jurisdiction and venue of the courts of The United Kingdom for any disputes arising out of this Sweepstakes.
 

AMENDMENTS TO RULES

The sponsor has a right to amend these rules at any time during the Pirate Band competition;  upon notice.
 

WHAT IF SOMETHING UNEXPECTED HAPPENS AND THE COMPETITION CAN’T RUN AS PLANNED?

If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) affects the fairness and/or integrity of this Pirate Band Competition; we reserve the right to cancel, change or suspend this  Pirate Band competition;  This right is reserved whether the event is due to a human or technical error. If a solution cannot be found to restore the integrity of the Pirate Band competition;  we reserve the right to randomly select a winner from among all valid Entries received before we had to cancel, change or suspend the  competition; 

If you attempt to compromise the integrity or the legitimate operation of this Pirate Band Competition;  by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law and we may ban you from participating in any of our future Pirate Studios promotions.
